These Terms and Conditions of Use (the “TERMS AND CONDITIONS USE”) apply to the Art Gallery of Western Australia Website located at https://artgallery.wa.gov.au and the shop online https://shop.artgallery.wa.gov.au for all purchases.
In this document –
"Gallery Shop", "AGWA Shop" or "Shop" means the AGWA's shop. Such shop is an agent of the AGWA.
"business day" means a day excluding a Saturday, Sunday or public holiday in Perth, Western Australia.
If you wish to make a purchase from the Art Gallery of Western Australia ("AGWA") website and shop website, you must be of legal age. If you are under the age of eighteen (18), please ensure you have the permission of a parent or guardian before proceeding to checkout. Any purchases made without the required permission are non-refundable. All personal information provided to us must be correct and truthful at the time of purchase. Any attempts of fraud will be detected and passed on to the appropriate authorities.
Purchase for Personal Use Only
All items in the AGWA Shop are to be purchased for private use only and not for resale. By placing your order, you certify that you are purchasing products for personal use only and not for resale. The AGWA has the right to decline orders.
Returns and Refunds
Please choose carefully as the AGWA does not provide exchanges or refunds in respect to purchases if –
a) you have changed your mind;
b) you have simply ordered the wrong product;
c) you have found that product elsewhere (whether cheaper or not); or
d) at the time of having brought the product you were aware, made aware or should have been aware that the product was or may have been imperfect or otherwise unfit for purpose.
Goods are non-refundable unless faulty or your refund request is approved by the Retail Store Manager. Exchange or refund requests are to be made within 14 days with proof of purchase. There shall be no exchange on earrings, on account of hygiene reasons.
To be eligible to return your item(s), you must first contact the AGWA Shop and arrange approval for your item(s) to be returned via post with a copy of your proof of purchase.
Returns can not be made in store. Please see below for returns procedure.
Items returned without approval may be rejected, in which case return postage costs will be the responsibility of the customer. If you are shipping an item back to us, you should consider using a trackable shipping service or purchasing shipping insurance. We can’t guarantee that we will receive your returned item(s). The AGWA Shop shall not be held responsible or liable, in negligence or howsoever, for goods lost in the post.
You are deemed to have used all reasonable efforts thoroughly to inspect the product at or before the time of purchase.
Where Items are faulty, have been incorrectly described, or are not fit for intended purpose, you can choose between a refund, exchange or Store Credit Note. Faulty merchandise returned within 14 days will be replaced where possible, if not, a full refund will be given. Please always retain your receipt for proof of purchase.
Our Returns Policy applies to all online and shop sales.
To return your purchase please follow this easy procedure. Contact email@example.com or firstname.lastname@example.org and advise us that you would like to return your purchase. We will respond as soon as possible. If your request is approved, please post your purchase either in your own packaging or an Express Post satchel. Either is fine, however, we require a tracking number for your postage . If you do not supply us with this number we will not be able to take any responsibility for your return not arriving to us. Exchange and Refunds
When you returned item(s) are received and inspected, we will notify you via email. We will also notify you of the approval or rejection of your exchange / refund.
If your exchange request is approved, this will be processed, and a new item will be mailed out to you. Additional postage fees may apply for bulky or high value items as described within the product description.
If your refund request is approved, this will be processed, and a credit will automatically be applied to your credit card as per your original payment method (please allow 5 business days for this to be processed).
Late or Missing Refunds
If you haven’t received your refund within the processing period, first check with your bank account. Then contact your credit card company, it may take some time before your refund is officially posted.
Next contact your bank. There is often some processing time before a refund is posted.

Orders and Product Availability
All orders will be processed within 3 business day of the order being entered into our system. Please allow an additional 10 Business days from this date for your order to arrive. During busy retail periods (Like Christmas) delays may occur. Please see below for more information.
Should your item(s) is not available for any reason, you will be contacted immediately by one of our Staff members.
Should you be looking for a product you have seen in our store that is not listed online, please contact us to obtain a price and have a mail order processed on 08 9492 6712 or at email@example.com

During Christmas/New Year period the delivery of the AGWA Shop orders may be delayed. In an effort to achieve delivery before December 24, we advise customers to place their orders as early before December 12 as possible. From December 24 – January 2 mail items will not be posted unless they are express. Normal postage procedures will resume after this period.
Pricing and Currency
All pricing is in Australian Dollars and includes GST. All prices are subject to change without notice and all items remain property of the AGWA until paid in FULL.

The Gallery Shop does not store any of your Credit Card information when you make a purchase. Our secure, encrypted payment gateway is provided by Stripe so you can be sure your personal details are protected. For security purposes please do not send cash to pay for your order. Also, please do not include your credit card number in any email communication.
Sites displayed in search results or linked to by email@example.com Gallery Shop are edited and controlled by unrelated parties. We may produce search results, automatically generated content and/or links to sites that some people find objectionable, inappropriate, or offensive.
We cannot guarantee that a search or review of the AGWA Shop will not located unintended or objectionable content and assume no responsibility for the content or content otherwise listed in or linked to by the AGWA Shop.
On-site Use Only
You may not take content from https://shop.artgallery.wa.gov.au and reformat and display any content, or mirror store on another website. You may not send automated queries of any sort or “metasearch” https://shop.artgallery.wa.gov.au
Changes in Terms and Conditions
The AGWA and the Gallery Shop reserves the right to modify, replace, revoke or terminate our Terms and Conditions of Use in the future, for any reason, and without notice, without liability to you or any other user or any third party. Please review these Terms and Conditions of Use from time to time so that you will be appraised of any changes. Limitation of Liability
If the AGWA is found to have breached any contract with you or any other obligation owed to you, the AGWA's total liability to you will be limited to a maximum of the purchase price of the item purchased by you.
